Boston Scientific and Johnson & Johnson Settle Guidant Litigation

February 17, 2015—Boston Scientific Corporation and Johnson & Johnson have settled the breach of merger agreement lawsuit brought by Johnson & Johnson against Guidant Corporation related to Boston Scientific’s acquisition of Guidant. 

According to a Boston Scientific press release detailing the settlement, the lawsuit was initially filed in 2006 and sought $7 billion, alleging that Guidant breached its merger agreement with Johnson & Johnson. The current settlement will see Boston Scientific pay Johnson & Johnson $600 million, and the company also agrees not to bring patent infringement or other claims related to Johnson & Johnson’s SMART, SMART Control, or SMART Flex stents.
